Subject: Urgent Action Needed to Restore Public Access to the Nolichucky River

The Wilmington and Nashville District of the U.S. Army Corps of Engineers issued violations and initial corrective measures on November 20, 2024.

The Tennessee Department of Environment and Conservation issued Notices of Violation on December 4, 2024.

The Cherokee National Forest has issued a Notice of Trespass against the railroad.

NCDEQ Division of Water Resources put a stop to rampant material removal from the river corridor. They also requested an update to the railroad’s river safety plan to include a flagging team for any in river construction activities to insure organized, safe passage for paddlers.

We expect Pisgah National Forest to follow suit and fulfill its responsibility in protecting public access and commercial operations.

Despite these clear regulatory actions, the railroad continues to control the narrative and obstruct access, ignoring both the spirit and the letter of these enforcement measures. Federal leadership is critical to ensuring compliance and restoring access to the Nolichucky River.

We urge you to step in and advocate for swift enforcement of these violations. The railroad must be held accountable and required to restore legal access to the river without further delay.
